How the fine is worked out

The set fine is a rate per km/h over the limit, from Schedule 43 of the Highway Traffic Act. Regular and construction zones: $2.50 per km/h for 1–19 over, $3.75 for 20–29, $6.00 for 30–49. Community safety zones and construction zones with a worker present: $5.00, $7.50 and $12.00. At 50 km/h or more over, Schedule 43 says “No out of court settlement”.

A victim fine surcharge is added under O. Reg. 161/00: $10 on a fine up to $50, $15 to $75, $20 to $100, $25 to $150, $35 to $200, $50 to $250, $60 to $300, $75 to $350, $85 to $400, $95 to $450, $110 to $500, $125 to $1,000, and 25% of the fine above $1,000. Where a fine has cents (for example $3.75 × 21 = $78.75) this tool uses the next band up, an assumption because the regulation lists whole dollars only.

Demerit points and stunt driving

Per ontario.ca: 3 points for 16–29 km/h over, 4 points for 30–49, 6 points for 50 or more. Stunt driving includes 40 km/h or more over on roads with a limit under 80, 50 km/h or more over anywhere, and 150 km/h or more. A stunt conviction carries a $2,000–$10,000 fine, an immediate 30-day licence suspension, a 14-day vehicle impoundment and 6 points. Novice drivers face at least a 30-day suspension for speeding 30 km/h or more over.

Frequently asked questions

Is a fine doubled in a community safety zone?

Yes. Schedule D sets $5.00, $7.50 and $12.00 per km/h, twice the regular Schedule B rates.

Why is there no fine at 50 over?

Schedule 43 gives no out of court settlement at 50 km/h or more over, so you cannot simply pay. It is also a stunt driving threshold.

Does the total match my ticket?

Your ticket's total payable can also include court costs. This tool does not add them because that amount was not verified against a primary source; check the total on your ticket.
