How it works

Regular rate = (base rate × total hours + differential earnings) ÷ total hours. Overtime premium = 0.5 × regular rate × hours over 40. Gross pay = straight-time pay for all hours + the premium. A percent differential is applied to your base rate; cents per hour are added as dollars (150 cents = $1.50).

Source: 29 CFR 778.207(b) says the Act requires including “such extra premiums as nightshift differentials (whether they take the form of a percent of the base rate or an addition of so many cents per hour)” in the regular rate. 29 CFR 778.207. The half-time premium on hours over 40 follows 29 CFR 778.110.

Gross pay estimate only

Gross pay before any tax or deduction. This assumes an hourly, non-exempt employee paid straight time for every hour, with overtime after 40 hours in the workweek. State law may differ (for example, daily overtime in some states), as can union contracts and other pay such as bonuses. Confirm with your employer or state labor agency.
