This is a wage estimate, not an exemption test. The FLSA generally requires time-and-a-half after 40 hours for covered nonexempt employees, but regular-rate, fluctuating-workweek, public-sector, agricultural and professional exemptions can change the result. California and Colorado, among others, also have daily or industry-specific rules.
