Under s.46 of the Trademarks Act, a registration lasts an initial 10 years from the registration date and renews in 10-year periods when the renewal fee is paid. The fee period opens at least six months before expiry and closes no earlier than six months after it.

How the dates are worked out

Section 46(1) puts a registration on the register for an initial period of 10 years beginning on the day of registration, and for renewal periods of 10 years if the prescribed renewal fee is paid within the prescribed period. This calculator shows the expiry as the 10th anniversary of the registration date, and the next expiry 10 years after that.

Section 46(6) says the prescribed period begins at least six months before expiry and ends no earlier than six months after it. The two window dates shown are exactly six months either side of expiry. The exact prescribed dates are set by the Trademarks Regulations and appear in the Registrar's renewal notice, so confirm them before relying on the last day.

What this does not cover

Assumptions: 29 February registrations are treated as 28 February in years without one, and month arithmetic keeps the same day of the month, clamped to month end.

How long does a Canadian trademark registration last?

A registration is on the register for an initial period of 10 years beginning on the day of registration, then for renewal periods of 10 years each, if the renewal fee is paid in time (Trademarks Act s.46(1)).

When can I renew a Canadian trademark?

Section 46(6) says the period for paying the renewal fee begins at least six months before expiry and ends no earlier than six months after it. This calculator shows those two dates as the guide; the Registrar's renewal notice and the Trademarks Regulations give the exact dates.

What happens if the renewal fee is not paid?

The Registrar sends a notice to the registered owner, and if the fee is still not paid within the prescribed period the registration is expunged, deemed expunged at the expiry of the period (s.46(2), (3)).

My trademark was registered before June 2019. Is it also 10 years?

This tool does not calculate that. Registrations made before the 2019 change followed an older term, and that rule is not stated in the section of the Act this page relies on. Check the register entry or ask the Canadian Intellectual Property Office (CIPO).
