What the General Rules allow an administrator to charge
Section 66.12(6)(b) of the Bankruptcy and Insolvency Act requires a consumer proposal to provide for the administrator's prescribed fees and expenses. Rule 129 of the General Rules prescribes them: $750 payable on filing a copy of the proposal with the official receiver, $750 on approval or deemed approval by the court, 20% of the moneys distributed to creditors, counselling, the filing fee, the registrar fee and applicable sales taxes.
Rule 131 sets counselling at $85 per individual session or $25 per person per group session, and OSB Directive 1R8 provides for two sessions. Rule 132(1)(c) sets the consumer proposal filing fee at $100 in the Rules; the OSB indexes its fees for consumer prices every March 31, and its table shows $123.17 for 2025-26, which this tool uses unless you change it. The registrar fee is $50 (Schedule, Part II, item 3(b)).
How the estimate treats tax
The Rules say applicable federal and provincial taxes on goods and services are added. The tool applies your rate to the administrator's remuneration only; counselling may be taxed differently, so ask your trustee for the exact invoice.
Example
If creditors are to receive $10,000 and there is no sales tax: $1,500 + 20% of $10,000 ($2,000) = $3,500 of trustee fees, plus $170 counselling, $123.17 filing and $50 registrar fee, for a total of $13,843.17.
